NEW ALBANY, IN (WAVE) - Evaluations are complete after a judge ordered two medical experts to determine whether William Clyde Gibson is competent to stand trial, but the results are not public record, yet.
The location of the jury trial is also still unknown.
Prosecutors and defense attorneys reviewed two separate reports conducted by a psychiatrist and psychologist during a pre-trial conference Wednesday. A judge set a date for September 28 to determine when a competency hearing will take place.
"I feel confident that Mr. Gibson will be found competent to stand trial; however, that decision will be with that court and not me," Floyd County Prosecutor Keith Henderson said.
Gibson's death penalty case is on track for a February jury trial. A venue change is still to be determined, but will likely happen in one of two scenarios. One option would require jury selection from a different jurisdiction. The jurors would be brought to Floyd County. The second option requires the entire trial to be held outside of Floyd County.
"I believe the court is leaning towards having the jurors selected and brought to Floyd County," Henderson said.
A judge will determine the venue change during the September 28 hearing.
While Gibson is charged with three murders, each case will be tried individually. Henderson is pursuing the death penalty involving victim Christine Whitis.
Gibson is also accused of killing Stephanie Kirk in spring 2012 and Karen Hodella in 2002.
